Warranty Terms and Conditions

Manufacturer's / Standard Warranty: means any expressed or implied warranty applicable to the sale of Your Product for a specific period of time from the original date of purchase of Your Product.

Mechanical or Electrical Failure: means a sudden or unforeseen failure of Your Product arising from a mechanical or electrical fault.

Original Date of Purchase: means the date shown on the purchase receipt and/or Tax Invoice.

Original Purchase Price: means the amount shown on the purchase receipt and/or Tax Invoice being the cost of Your Product.

You, your: means the person or persons named as the purchaser on the original purchase receipt and / or Tax Invoice.

Your Product: means any electrical or battery operated product that you purchase for domestic use as described in the purchase receipt and/or Tax Invoice.

We, Us, Our, Private Blends: refers to the selling retailer or an authorised agent of the selling retailer

What does Manufacturer's / Standard Warranty Cover?

It warrants that the products to be free of defects in materials or workmanship and mechanical or electrical fault, and shall conform to specifications at the time of shipment, for a certain period from the original date of purchase. During the warranty period, any defective products will be repaired or replaced, at Private Blends option, on a return-to-base basis. This Warranty covers defects that Private Blends determines are no fault of the user.

What does Extended Warranty cover?

For Australia customers only, the Extended Warranty extends the coverage of the manufacturer's / standard Warranty described above. That is, the product will be free of defects in materials or workmanship and mechanical or electrical fault, and shall conform to specifications at the time of shipment, for a certain period of time from the end date of the original Limited Warranty. During the warranty period, any defective products will be repaired or replaced, at Private Blends option, on a return-to-base basis. This Extended Warranty covers defects that Private Blends determines are no fault of the user.

Transfer of Warranty

This manufacturer's / standard and extended warranty can be transferred to a new owner at the sale of Your Product providing written advice from You is forwarded to Private Blends customer service within 7 (seven) days of the transfer of ownership of Your Product.

Coverage Dates of the Extended Warranty

Extended warranty start as soon as the manufacturer's / standard warranty cover ends. For example: A product purchased on 14th June 2016 having 1 year standard warranty and 1 year extended warranty. The extended warranty will start on 14th June 2017 and ends on 13th June 2018 (AEST, Sydney time)

Returning Your Product to Private Blends

You must obtain prior approval and an RA (return authorization) number from Private Blends before returning any product by contacting our customer service. All accessories come with the product must be included in your return. Please pack properly to avoid any physical damage to the product. The Warranty will not be honoured if the product is not properly packed and it arrived with physical damage due to transport. Once packed, send the product to Private Blends with transportation and insurance charges paid.

What we will do

Once received, we will examine the product for any obvious signs of user abuse or damage as a result of transport. If the product has been abused, damaged in transit, or is out of warranty, we will contact you with an estimate of the cost for service, materials, and return freight. Warranty work will be performed and Private Blends will ship and insure your product to your Australia address free of charge. Shipping charges for non-warranty work are the responsibility of the Buyer.

Limitation of Liability

In no event shall Private Blends's liability to buyer ever exceed the original purchase price of the product's covered by this document.

Exclusion of Damages

Private Blends shall not in any event or under any legal theory (whether tort, contract or otherwise) be liable for indirect, incidental, special, consequential or punitive damages, including without limitation lost profits, whether arising from the sale of products, any defect in the products, any use or inability to use the products, or otherwise, even if Private Blends has been advised of the possibility of such damages.

Force Majeure

Any failure by Private Blends to perform any of its obligations shall not be deemed a breach if such failure is caused by strikes (including without limitation those affecting receipt, manufacture, production or shipment of materials), labour disputes or any concerted labour activity, lockouts, boycotts, embargoes, governmental regulations, orders or restrictions, wars, war-like actions, civil commotions, riots, uprising, revolutions, epidemics, fires, floods, storms, earthquakes, other natural occurrences, or any other causes, circumstances or conditions beyond the reasonable control of Private Blends.

Choice of Law

This order and any dispute or claim relating to it or the Extended Warranty sold hereunder shall in all respects be governed by and construed according to the laws of the State of NSW, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement which will continue in full force and effect.
